WHAT IS FUTURE CARE (FC)?
Future Care allows IAP claimants to seek additional compensation for treatment or counselling after their hearing is held. In order to be considered for additional compensation, a Future Care Plan (FCP) is required. Future Care awards, such as treatment, counselling, or traditional healing, can amount to $10,000 for general care and can be increased to $15,000 if treatment by a psychiatrist is required.
WHO DECIDES ON THE COMPENSATION?
The Adjudicator (decision-maker) can award you with Future Care funding if your claim for abuse is successful.
In deciding whether to provide you with additional compensation to use for Future Care, the Adjudicator will consider:
- The effects the abuses have had on you;
- Treatment you have already received;
- Whether you need to travel to obtain treatment;
- Whether other funding sources are available for all or part of the cost; and,
- Whether you have both a need for the proposed treatment and a genuine desire to get that treatment.
HOW DO I DEMONSTRATE THE NEED AND GENUINE DESIRE FOR FUTURE CARE?
To demonstrate your need and genuine desire for Future Care you should give the Adjudicator a well-thought-out plan for the treatment you wish to seek.
You will need to explain and give details of the type of treatment or counselling you intend to pursue or continue. Before your hearing you should work with your lawyer or a counsellor to prepare a plan for the treatment or counselling you would like to receive.
You will need to include the following information:
- Type of treatment(s);
- Location of treatment(s);
- Cost of treatment(s) - including transportation, accommodations, and program fee if relevant;
- Description of treatment; and
- Why you believe this treatment will help in your healing journey.
Examples of possible Future Care activities include counselling sessions, treatment for substance abuse, or traditional healing techniques, such as attending sweats or talking circles.
HOW DO I ESTABLISH A NEED FOR FUTURE CARE?
You do not have to provide any supporting documents, other than a detailed Future Care Plan, to demonstrate a need or desire for future treatment or counselling.
WHO CAN HELP ME OBTAIN MORE INFORMATION ABOUT FUTURE CARE PLAN?
Future care is optional, and not a mandatory component of the IAP.
As a claimant, it is your responsibility to ensure your lawyer is aware that you wish to pursue Future Care. If you are interested in submitting a Future Care plan, your lawyer will work with you to create a plan.
As described in the Expectations of Legal Counsel document, lawyers should facilitate their clients’ healing process by working with their clients to ensure that an appropriate Future Care Plan has been developed (where applicable) for presentation at the hearing.
If you do not have a lawyer, you must prepare your own Future Care plan. Your Claimant Support Officer can assist you in answering any questions you may have and provide you with more information about Future Care. The Health Support Program offers emotional support services provided by Resolution Health Support Workers, cultural support services provided by Elders, professional counselling, assistance with the cost of transportation to access counselling, and Elder and/or Traditional Healer services to eligible former Indian Residential School students and their families throughout all phases of the Indian Residential School Settlement Agreement.
