IAP accepting applications from Kivalliq Hall claimants

Regina, May 21, 2019 -- The Indian Residential Schools Adjudication Secretariat (IRSAS) has begun accepting applications to the Independent Assessment Process (IAP) for abuse claims at Kivalliq Hall in Rankin Inlet, Nunavut.

The IAP was established in 2007 under the Indian Residential Schools Settlement Agreement to resolve claims of serious physical, sexual or emotional abuse suffered at Indian Residential Schools.

Kivalliq Hall was added to the list of eligible schools under the Settlement Agreement in July 2018 following a decision from the Nunavut Court of Appeal, which upheld a lower Court decision. Following discussions between Canada and Nunavut Tunngavik Incorporated (NTI), the Courts issued an order setting the implementation terms on April 25, 2019. The Courts have set January 25, 2020 as the application deadline for Kivalliq Hall claims.

Kivalliq Hall was a 40-bed residence in Rankin Inlet that operated between June 12, 1985 and December 31, 1997. In addition to residents of Kivalliq Hall, some individuals may also be eligible to apply to the IAP as non-residents claimant if they suffered abuse when they were allowed on the grounds of Kivalliq Hall to take part in an authorized activity (for example a sports event) when the abuse took place.

Canada will conduct a Notice Program that includes radio, television and print advertisements in local, regional and national media outlets to inform individuals who resided at Kivalliq Hall that they may be eligible for compensation under the IAP. In addition, Secretariat staff are working with NTI and the Kivalliq Inuit Association to ensure that individuals who attended the facility have access to information about the IAP.

Individuals who resided at Kivalliq Hall may also be eligible for the Common Experience Payment, which is administered by the Government of Canada.

The Indian Residential Schools Adjudication Secretariat is an independent, quasi-judicial tribunal that administers the Independent Assessment Process. It operates independently from the Parties to the Settlement Agreement, including the Government of Canada. IRSAS has resolved more than 99% of the 38,000 claims it has received. The Secretariat is working towards resolving all remaining claims and completing its mandate by March 31, 2021.
