Independent Assessment Process Notice about Estate Claims

The Indian Residential Schools Adjudication Secretariat makes every effort to expedite the Independent Assessment Process (IAP) claims of survivors who are elderly or in ill health. However, in the unfortunate event that a claimant should pass away before the claim is resolved, the Adjudication Secretariat has worked with their estate to help prepare the case to be heard by an adjudicator.
However, recent cases have raised questions about whether estates can bring claims in the IAP. While these cases are being decided, the Chief Adjudicator has frozen work on all other estate claims that have not yet been scheduled for a hearing. During this review:
- No new estate claim hearings or estate pre-hearing teleconferences (EPHT) will be scheduled.
- Adjudicators will write decisions for estate claims that have had a hearing. Reviews will be conducted if requested.
- We will continue to receive estate documents, so that we can communicate with the authorized representative of the estate about the claim.
We will provide information on the outcome of the review of estate cases when it is available.
