New form to request decision review

September 17, 2013

In an effort to ensure speedy processing, the Indian Residential Schools Adjudication Secretariat is introducing a new form for use by claimants who wish to request a review of a decision made under the Independent Assessment Process.

There are two grounds on which claimants can request that an arbitrator’s decision be reviewed:

  • If the adjudicator, or the reviewing adjudicator, did not properly apply the IAP model to the facts as found by the adjudicator; and
  • If the adjudicator’s decision contains a significant (“palpable and overriding”) error.

The grounds on which the review is being requested must be indicated on the form. In addition, claimants must provide a short written statement describing their objections to the decision. Please limit your statement to no more than 1,500 words.

Claimants are expected to use the form when requesting a review. Failure to do so could lead to delays in processing your request.

The form can be downloaded below. Once it is complete, please send it to the Secretariat by mail for by fax at the address listed on the form.
